EU Constitutional Law and Fundamental Rights

Celem kursu jest:

  • uzupełnienie wiedzy studenta o świadomość prawną w zakresie konstytucyjnych podstaw Unii Europejskiej (UE) jako „wspólnoty prawa i wartości”, ze szczególnym uwzględnieniem praw podstawowych UE
  • utrwalenie informacji dotyczących źródeł prawa i podstawowych zasad unijnego porządku prawnego w kontekście ochrony praw podstawowych
  • przedstawienie ewolucji konstytucyjnych podstaw UE oraz ukazanie roli Trybunału w tym procesie
  • ukazanie powiązań prawno-kulturowych pomiędzy demokracją a praworządnością (rule of law)
  • „osłuchanie” studenta z anglojęzyczną terminologią unijną i tzw. Legal English w ogólności

 

Kurs w wymiarze 30 godzin (4 ECTS) łączy w sobie wykład z metodami pracy zespołowej i indywidulanej na bazie kazusów i analizy orzecznictwa.

The aim of this tailor-made course is to give students a grounding in the institutional and constitutional framework of the European Union in order to deepen their understanding of the EU specific issues relevant for the future graduates in their professional life. This course builds on the prior, basic orientation of students in the field of the European Union law and develops this knowledge by introducing the prism of European constitutionalism into the analysis of the EU Fundamental Rights. As part of the Jean Monnet Module, the course is scheduled for 30 hours and has been intended to provide an introduction for studying other, more specific issues, described below, in the following syllabuses. This course will be conducted in English, offering students the chance to practice legal English and acquire vocabulary relevant in discussions about European integration.

The European Union law is first presented in its historical framework by considering the constitutional evolution of the EU, including an analysis of the impact of the Treaty of Lisbon. The law relating to the institutions as this post-Lisbon state is then analyzed in detail, beginning with the political institutions (including analysis of the legislative process at the European Union level). The institutional structure and jurisdiction of the Court of Justice of the European Union are also examined, as are the forms of litigation which come before the Court
